A contested divorce is the type in which the spouses cannot arrive at an agreement on one or more key issues in order to conclusively terminate their marriage. When spouses cannot arrive at an agreement, even with the assistance of their legal counsel (if any), they must approach a court to adjudicate their dispute.

 

An uncontested divorce  is the type in which both parties arrive at an agreement on all issues. In California, an uncontested divorce could mean one of two things: You and your spouse agree on how to handle property, money, and parenting issues. In some cases, this means neither party will need to file a response to court filing.

Divorce Or Legal Separation

Legal Separation is a court order that mandates the rights and duties of a couple while they are still married, but living apart. In a divorce, the spouses are no longer married.

The initial petition often demands much more than the Petitioner expects.  Most Petitioners often use the initial petition as a wish list.

In most cases, the Respondent (also known as the defendant or the person who didn’t file the divorce or legal separation) has a limited time to file an answer. The Respondent’s answer is usually brief, admitting or denying each assertion and asking the court to deny the Petitioner’s request.
